konusunda at\u0131lacak en \u00f6nemli ad\u0131md\u0131r. Bu y\u00f6ndeki geli\u015fmeyi t\u0131kayan Anayasa ve Anayasan\u0131n egemen k\u0131ld\u0131\u011f\u0131 totaliter zihniyettir.<\/li>\n<li>Mevcut anayasan\u0131n \u015fu ya da bu maddesini de\u011fi\u015ftirerek, \u00f6zledi\u011fimiz demokratik hukuk devletini tesis edemeyiz.<\/li>\n<li>Bug\u00fcn \u00e7ok partili parlamenter sistem sadece bir vitrin te\u015fkil etmekte; resmi ideolojiye ba\u011f\u0131ml\u0131l\u0131k s\u00fcrmektedir.<\/li>\n<li>Mutabakat yani \u201coy birli\u011fi\u201d ile \u201coy \u00e7oklu\u011fu\u201d ayr\u0131 \u015feylerdir; bunlar\u0131 birbirine kar\u0131\u015ft\u0131rmamak gerekir.<\/li>\n<li>Demokratikle\u015fme konusunda y\u00f6netici kadrolar\u0131n ne kadar samimi olduklar\u0131 sorgulanabilir.<\/li>\n<li>Yarg\u0131 sadece mahkeme de\u011fildir. Adalet sistemi haz\u0131rl\u0131k soru\u015fturmas\u0131n\u0131 yani savc\u0131 ve polisi de kapsar.<\/li>\n<li>Yarg\u0131ya \u00e7ok modern y\u00f6ntemlerle delil toplayarak, dosya haz\u0131rlama imk\u00e2n\u0131n\u0131 vermemiz l\u00e2z\u0131m.<\/li>\n<li>Anayasa Mahkemesi kald\u0131r\u0131lacak; yerine Y\u00fcksek Mahkeme kurulacakt\u0131r.<\/li>\n<li>Y\u00fcksek Mahkeme\u2019nin \u00fcyeleri Devlet Ba\u015fkan\u0131nca atan\u0131p, meclisce onaylanan \u00fcyelerden olu\u015facak ve aran\u0131lan nitelikleri koruduklar\u0131 s\u00fcrece, ya\u015fam boyu g\u00f6revde kalabileceklerdir.<\/li>\n<li>\u0130dari mahkemeler ve Dan\u0131\u015ftay kald\u0131r\u0131lacakt\u0131r.<\/li>\n<li>DGM kald\u0131r\u0131lacakt\u0131r \u00e7\u00fcnk\u00fc,devletin mahkemesi olmaz; devletin g\u00fcvenlik g\u00fcc\u00fc olur.<\/li>\n<li>T\u00fcketici haklar\u0131 ve \u00e7evrenin korunmas\u0131nda \u00f6zel ihtisas mahkemeleri g\u00f6rev alacakt\u0131r.<\/li>\n<li>Hukuk evrenseldir. Yerel hukuk olamaz \u00e7\u00fcnk\u00fc, insan d\u00fcnyan\u0131n her yerinde ayn\u0131 insand\u0131r.<\/li>\n<li>Yass\u0131ada Mahkemesi\u2019nin Y\u00fcksek Adalet Divan\u0131 olarak an\u0131lmas\u0131, hukuka hakarettir.<\/li>\n<li>Yarg\u0131 devletin asli i\u015flevlerinden birisidir ama, bu devlet yarg\u0131s\u0131 demek de\u011fildir.<\/li>\n<li>Devletin yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131n\u0131 temin etmesi demektir.<\/li>\n<li>Hukuka sayg\u0131l\u0131 hi\u00e7bir T\u00fcrk savc\u0131s\u0131 ve h\u00e2kiminin mevcut sistemden yana oldu\u011funa inanm\u0131yoruz.<\/li>\n<li>Hukuk devleti, bireyin hukukunu koruyan devlett\u00eer; devletin hukukunu de\u011fil.<\/li>\n<li>Haks\u0131zl\u0131klar kar\u015f\u0131s\u0131nda toplum f\u0131rsat bulunca tepki g\u00f6stermeli ki, ileriye d\u00f6n\u00fck olarak bir altyap\u0131, k\u00fclt\u00fcr olu\u015fsun.<\/li>\n<li>Bir darbeye, m\u00fcdahaleye maruz kalan politikac\u0131larda su\u00e7ludur ama, demokratik bir \u00fclkede darbe savunulamaz.<\/li>\n<li>Bug\u00fcn siyasi partilerin il ya da il\u00e7e \u00f6rg\u00fctleri bir genel ba\u015fkan\u0131n emri ile feshedilebiliyorsa, demokratik hukuk devletinden s\u00f6z edemeyiz.<\/li>\n<li>T\u00fcrkiye kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesine sad\u0131k yeni bir anayasa ile yeni bir hukuk devleti tesis etmeli ve demokrasisini sivil ya da askeri hi\u00e7bir diktaya izin vermeyecek \u015fekilde kurumla\u015ft\u0131rmal\u0131d\u0131r.<\/li>\n<li>\u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz sistemde Ordu, halk oylamas\u0131 ile se\u00e7ilmi\u015f Devlet Ba\u015fkan\u0131\u2019n\u0131n Savunma Bakan\u0131\u2019na ba\u011fl\u0131d\u0131r.<\/li>\n<li>Adalet mekanizmas\u0131n\u0131n t\u00fcm parasal ihtiya\u00e7lar\u0131, adli har\u00e7lar\u0131n olu\u015fturaca\u011f\u0131 ayr\u0131 bir fondan kar\u015f\u0131lanacak; adalet mekanizmas\u0131 devlet b\u00fct\u00e7esine t\u00e2bi olmayacakt\u0131r.<\/li>\n<li>Ticaret hukuku uluslararas\u0131 niteli\u011fe kavu\u015fturulacakt\u0131r. Aksi halde d\u0131\u015fa a\u00e7\u0131lmaktan s\u00f6z edemeyiz.<\/li>\n<li>Biz affa kar\u015f\u0131y\u0131z. \u0130nsanlara kar\u015f\u0131 i\u015flenmi\u015f su\u00e7lar\u0131 devletin affetme yetkisi yoktur. Devlet ancak kendisine kar\u015f\u0131 i\u015flenmi\u015f su\u00e7lar\u0131 affedebilir.<\/li>\n<li>Liberal Demokrat Parti mevcut d\u00fczene tepki partisidir ve halk\u0131m\u0131z\u0131n benzer tepkileri oran\u0131nda b\u00fcy\u00fcyecek ve g\u00fc\u00e7lenecektir.<\/li>\n<li>\u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasa, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesinin tavizsiz benimsendi\u011fi \u00fc\u00e7, d\u00f6rt sayfal\u0131k bir metinden ibaret olacakt\u0131r.<\/li>\n<li>Yasama, dar b\u00f6lge ve iki turlu se\u00e7imle asgari %50+1 oy alan parti temsilcilerinin olu\u015fturdu\u011fu Temsilciler Meclisi\u2019nce deruhte edilecektir.<\/li>\n<li>Y\u00fcr\u00fctme, iki turlu se\u00e7imle millet taraf\u0131ndan asgari %50+1 oyla se\u00e7ilen bir Devlet Ba\u015fkan\u0131\u2019na ve onun kuraca\u011f\u0131 Kabineye tevdi edilecektir.<\/li>\n<li>Yarg\u0131, Ba\u015fkan ve \u00fcyelerinin Devlet Ba\u015fkan\u0131nca atan\u0131p, meclisce onaylanan ve aran\u0131lan nitelikleri korudu\u011fu s\u00fcrece ya\u015famboyu g\u00f6revde kalacak hakimlerden bir Y\u00fcksek Mahkeme\u2019ye ba\u011fl\u0131 adalet mekanizmas\u0131na tevdi edilecektir.<\/li>\n<li>*Adalet mekanizmas\u0131n\u0131n b\u00fct\u00e7esi, adli har\u00e7lardan olu\u015fan ba\u011f\u0131ms\u0131z bir fon taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Ho\u015f geldiniz.<\/strong><\/p>\n<p>Efendim bu ak\u015famki konumuz hukuk, yarg\u0131 ve adalet. Bizim i\u00e7in en \u00f6nemli konu!<\/p>\n<p>\u0130nsanlar a\u00e7l\u0131\u011fa, yoksullu\u011fa, d\u00fczensizli\u011fe, pisli\u011fe vb her \u015feye tahamm\u00fcl edebilirler ama, adaletsizli\u011fe asla. Dahas\u0131, \u201cadalet m\u00fclk\u00fcn temelidir\u201d \u00f6zdeyi\u015finde de ifade buldu\u011fu \u00fczere; adalet bir toplumun \u201cmillet\u201d ve \u201cdevlet\u201d olabilmesinin de \u00f6n ko\u015fuludur.<\/p>\n<p>\u00ce\u015fte bu nedenlerle, Liberal Demokrat Parti olarak, T\u00fcrkiye\u2019de adalet mekanizmas\u0131n\u0131n d\u00fczg\u00fcn ve etkin \u00e7al\u0131\u015fmas\u0131n\u0131n teminini, devletin asli g\u00f6revi olarak de\u011ferlendiriyoruz. Zaten hedefledi\u011fimiz \u201c\u00c7a\u011fda\u015f uygarl\u0131k\u201dda, her \u015feyden \u00f6nce, \u00e7a\u011fda\u015f hukuk ve yarg\u0131 uygarl\u0131\u011f\u0131d\u0131r.<\/p>\n<p>\u00c7a\u011fda\u015f hukuk ve yarg\u0131 uygarl\u0131\u011f\u0131, bir milletin adil bir \u015fekilde y\u00f6netilmesi ve ba\u011f\u0131ms\u0131z yarg\u0131yla, insan hak ve \u00f6zg\u00fcrl\u00fcklerine sayg\u0131l\u0131, adaletli bir \u00fclkede ya\u015famas\u0131; devletin t\u00fcm vatanda\u015flar\u0131na bu teminat\u0131 eksiksiz vermesidir.<\/p>\n<p>Bu bak\u0131mdan, \u00f6zellikle i\u00e7inde bulundu\u011fumuz \u015fu d\u00f6nemde adalet ve yarg\u0131, \u00fczerinde duraca\u011f\u0131m\u0131z en \u00f6nemli konudur diyebilirim.<\/p>\n<p>Savundu\u011fumuz liberal demokrasi insan hak ve \u00f6zg\u00fcrl\u00fcklerini g\u00fcvenceye alan ve devleti \u201cdemokratik hukuk devleti\u201d olarak tan\u0131mlayan ilk ve tek doktrindir. Hukuk yoksa, insan hak ve \u00f6zg\u00fcrl\u00fckleri de yoktur.<\/p>\n<p><strong>Hukuk Yoksa, Hak ve \u00d6zg\u00fcrl\u00fck de Yoktur<\/strong><\/p>\n<p>Demokratik hukuk devleti demek, hukuka ba\u011fl\u0131, hukuka sayg\u0131l\u0131, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n m\u00fcessesele\u015fti\u011fi devlet demektir.<\/p>\n<p>Neden? \u0130nsan hak ve \u00f6zg\u00fcrl\u00fcklerinin teminat alt\u0131na al\u0131nabilmesi; g\u00fc\u00e7l\u00fcye kar\u015f\u0131, g\u00fc\u00e7s\u00fcz\u00fcn ve ayn\u0131 anlay\u0131\u015fla, devlete kar\u015f\u0131, bireyin korunabilmesi i\u00e7in.<\/p>\n<p>Devlet bu anlamda bir \u201chukuki m\u00fcessese\u201d olma vasf\u0131n\u0131 kaybetmesi halinde, me\u015fruiyetini yitirir.<\/p>\n<p>Demokratik hukuk devleti, yasama, y\u00fcr\u00fctme ve yarg\u0131 \u201cerk\u201d lerinin birbirinden ba\u011f\u0131ms\u0131z ve birbirini dengeleyen \u00fc\u00e7 g\u00fc\u00e7 olarak \u00e7al\u0131\u015fmas\u0131n\u0131 \u00f6ng\u00f6r\u00fcr. Dolay\u0131s\u0131yla, ba\u011f\u0131ms\u0131z yarg\u0131 yani, adalet mekanizmas\u0131n\u0131n kendi kendisini y\u00f6netmesi ve denetlemesi, demokratik hukuk devletinin olmazsa, olmaz ko\u015fuludur.<\/p>\n<p><strong>Yarg\u0131 ve Liberal Demokrasi<\/strong><\/p><p><strong><br><\/strong><\/p>\n<p>Biz inan\u0131yoruz ki, liberal demokrasi yarg\u0131n\u0131n sayg\u0131nl\u0131\u011f\u0131 ve etkinli\u011fi nisbetinde ger\u00e7ekle\u015febilir.<\/p>\n<p>Program\u0131m\u0131zda da ifade buldu\u011fu \u00fczere, biz kuvvetler ayr\u0131l\u0131\u011f\u0131 prensibine ve \u0130nsan Haklar\u0131 Evrensel Bildirgesi ile buradan do\u011fan Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019ne tavizsiz sad\u0131k bir devlet modelinden yanay\u0131z.<\/p>\n<p>Yeni bir anayasa ile g\u00fcvence alt\u0131na al\u0131nmas\u0131 \u00f6ng\u00f6r\u00fclen bu modelde yarg\u0131 ba\u011f\u0131ms\u0131zd\u0131r. \u201cBa\u011f\u0131ms\u0131z yarg\u0131\u201d tan\u0131mlamas\u0131na \u00e7ok dikkat etmek gerekiyor. \u015e\u00f6yle ki:<\/p>\n<p>Mal\u00fbm, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesi \u00e7er\u00e7evesinde \u00fc\u00e7 \u201cerk\u201d den yasama, kanunlar\u0131 yap\u0131yor; y\u00fcr\u00fctme, icradan sorumlu; yarg\u0131 ise, toplumu olu\u015fturan bireylerin, birbirleri ile olan anla\u015fmazl\u0131klar\u0131n\u0131 \u00e7\u00f6z\u00fcmlemekle kalmay\u0131p; bireyin devletle olan anla\u015fmazl\u0131klar\u0131n\u0131 da \u00e7\u00f6z\u00fcml\u00fcyor yani, tam anlam\u0131yla adalet da\u011f\u0131t\u0131yor.<\/p>\n<p>Ba\u011f\u0131ms\u0131z yarg\u0131daki esas ama\u00e7, yukar\u0131da da de\u011findi\u011fim gibi, g\u00fc\u00e7s\u00fcz bireyin gere\u011finde g\u00fc\u00e7l\u00fc devlete kar\u015f\u0131 da korunabilmesidir. B\u00f6yle olmad\u0131\u011f\u0131 s\u00fcrece \u201cdemokratik hukuk devleti\u201d nden s\u00f6z edemeyiz.<\/p>\n<p><strong>Bir \u201cdemokratik hukuk devleti \u201cmiyiz ?<\/strong><\/p>\n<p>Bu ba\u011flamda, hay\u0131r. T\u00fcrkiye bir demokratik hukuk devleti de\u011fildir. Neden?<\/p>\n<p>\u00c7\u00fcnk\u00fc, 1924\u2019den bu yana hi\u00e7bir anayasam\u0131z demokratik hukuk devletinin \u00f6n \u015fart\u0131 olan kuvvetler ayr\u0131l\u0131\u011f\u0131 prensibini benimsememi\u015f; yasama, y\u00fcr\u00fctme ve yarg\u0131 olarak adland\u0131r\u0131lan \u00fc\u00e7 g\u00fcc\u00fcn birbirinden tart\u0131\u015fmas\u0131z bi\u00e7imde ba\u011f\u0131ms\u0131z olacaklar\u0131 d\u00fczenlemeyi \u00f6ng\u00f6rmemi\u015ftir.<\/p>\n<p>T\u00fcrkiye\u2019de bu \u00fc\u00e7 g\u00fcce hep yasama (Parl\u00e2mento) egemen olagelmi\u015ftir. Oysa, do\u011fald\u0131r ki, yasama toplum b\u00fct\u00fcn\u00fcn\u00fc olu\u015fturan \u201ckar\u015f\u0131t\u201d demokratik guruplar\u0131n \u201c\u00e7\u0131kar\u201d iradelerine dayanarak se\u00e7tikleri temsilcilerden olu\u015fur. TBMM mensuplar\u0131 asl\u0131nda bizlerin \u201cvekilleri\u201d de\u011fil, parti \u201ctemsilcileri\u201d dir.<\/p>\n<p><strong>TBMM Toplumsal \u0130radeyi Yans\u0131tmaz<\/strong><\/p>\n<p>Bu yap\u0131s\u0131 ile Parl\u00e2mento (yasama) toplumsal iradeyi yans\u0131tmaz g\u00fcnk\u00fc, \u00fcyeleri (temsilciler) toplum b\u00fct\u00fcn\u00fcne de\u011fil, mensubu olduklar\u0131 siyasi partiye oy veren vatanda\u015flara kar\u015f\u0131 sorumludurlar.<\/p>\n<p>Yasaman\u0131n ger\u00e7e\u011fi bu olunca, y\u00fcr\u00fctmenin ba\u015f\u0131n\u0131n yani, Ba\u015fbakan\u0131n bu organ (Parl\u00e2mento) taraf\u0131ndan se\u00e7ilmesi, onu TBMM\u2019ye egemen siyasi iradeye ba\u011f\u0131ml\u0131 k\u0131lmaktad\u0131r. Neden?<\/p>\n<p>Bug\u00fcn adli mekanizma siyasi iradenin \u00fcr\u00fcn\u00fc olan y\u00fcr\u00fctmenin (H\u00fck\u00fcmetin) bir bakanl\u0131\u011f\u0131na, Adalet Bakanl\u0131\u011f\u0131\u2019na ba\u011fl\u0131d\u0131r. Bir di\u011fer ifade ile, adalet mekanizmas\u0131 siyasi iradeden ba\u011f\u0131ms\u0131z olmad\u0131\u011f\u0131 gibi; milli ya da toplumsal iradenin de \u00fcr\u00fcn\u00fc de\u011fildir.<\/p>\n<p>Hal b\u00f6yle olunca, hi\u00e7bir yarg\u0131\u00e7 \u201cYaz k\u0131z\u0131m T\u00fcrk milleti ad\u0131na\u201d diye karar veremez verse bile, sorgulan\u0131r, sorgulanmaktad\u0131r, sorgulanmaya da devam edecektir ve T\u00fcrkiye\u2019deki yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 tart\u0131\u015fmalar\u0131 s\u00fcr\u00fcp, gidecektir.<\/p>\n<p>Tekrar ediyorum, yarg\u0131n\u0131n ba\u011f\u0131ms\u0131z olabilmesi i\u00e7in, yasama ve y\u00fcr\u00fctmenin olas\u0131 hatta, ka\u00e7\u0131n\u0131lmaz tahakk\u00fcm\u00fcnden muhakkak ar\u0131nd\u0131r\u0131lmas\u0131 gerekir. Yarg\u0131, devletin asli bir i\u015flevidir par\u00e7as\u0131d\u0131r fakat, icradan ve yasamadan ar\u0131nd\u0131r\u0131lmas\u0131 gerekir. Nas\u0131l?<\/p>\n<p><strong>Ba\u015fkanl\u0131k Sistemi<\/strong><\/p>\n<p>Liberal Demokrat Parti, T\u00fcrkiye\u2019nin bir demokratik hukuk devleti olmas\u0131na engel bu temel sorunun \u00e7\u00f6z\u00fcm\u00fcn\u00fcn Ba\u015fkanl\u0131k Sistemi oldu\u011funa inanmaktad\u0131r. Ba\u015fkanl\u0131k Sistemi, T\u00fcrkiye\u2019nin bir demokratik hukuk devleti olmas\u0131n\u0131n teminat\u0131 olacakt\u0131r.<\/p>\n<p>Ba\u015fkanl\u0131k Sistemi\u2019nin benimsenmesi ise, ciddi anayasa de\u011fi\u015fikli\u011fini ima etmektedir.<\/p>\n<p><strong>Anayasa De\u011fi\u015fikli\u011fi \u015eart<\/strong><\/p>\n<p>\u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasa, kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesinin tavizsiz g\u00f6zetilerek haz\u0131rland\u0131\u011f\u0131, \u00fc\u00e7, d\u00f6rt sayfal\u0131k bir metinden ibaret olacak ve sadece \u015fu hususlar\u0131n i\u015fleyi\u015f esaslar\u0131na yer verecektir<\/p>\n<p>1. Yasama, dar b\u00f6lge ve iki turlu se\u00e7imle, asgari %50+1 oy alan siyasi parti temsilcilerinin olu\u015fturdu\u011fu bir Temsilciler Meclisi vas\u0131tas\u0131yla y\u00fcr\u00fct\u00fclecektir.<\/p>\n<p>B\u00f6ylelikle, siyasi partilerde ya\u015faya geldi\u011fimiz \u201clider sultas\u0131\u201d na da son verilecek; temsilciler (milletvekilleri de\u011fil) gurup karar\u0131 vb sorunlar olmaks\u0131z\u0131n, se\u00e7menlerinin ger\u00e7ek temsilcileri olarak yasama i\u015flevini yerine getirebileceklerdir.<\/p>\n<p>2. Adalet mekanizmas\u0131 (yarg\u0131), Ba\u015fkan ve \u00fcyelerinin Devlet Ba\u015fkan\u0131nca atan\u0131p, Meclisce onaylanan, aran\u0131lan nitelikleri korudu\u011fu s\u00fcrece ya\u015famlar\u0131 boyunca g\u00f6revde kalacak hakimlerden olu\u015fan bir Y\u00fcksek Mahkeme\u2019ye ba\u011flanacakt\u0131r. Bu mekanizman\u0131n b\u00fct\u00e7esi, adli har\u00e7lardan olu\u015fan ve y\u00fcr\u00fctmeden ba\u011f\u0131ms\u0131z \u00f6zel bir fon taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r.<\/p>\n<p>Bunun anlam\u0131, yarg\u0131da g\u00f6rev alan savc\u0131lar\u0131n, h\u00e2kimlerin (bug\u00fcnk\u00fc anlay\u0131\u015fla) \u201cdevlet memuriyeti\u201d vas\u0131flar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 yani, ba\u011f\u0131ms\u0131zla\u015fmalar\u0131d\u0131r.<\/p>\n<p>Kabul ediniz ki, bu insanlar y\u00fcr\u00fctmeden (siyasi otoriteden) maa\u015f ald\u0131klar\u0131 s\u00fcrece, birey ile devlet aras\u0131ndaki herhangi bir \u00e7at\u0131\u015fmada tarafs\u0131z kalamazlar. Bu insan do\u011fas\u0131na ayk\u0131r\u0131d\u0131r. Nitekim, ge\u00e7enlerde bir savc\u0131m\u0131z\u0131n, \u0130talya\u2019daki bir savc\u0131ya \u201cBen devlet memuruyum\u201d ifadesi, bunun somut delilidir:<\/p>\n<p>4. \u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasa, B\u0130RLE\u015eM\u0130\u015e M\u0130LLETLER \u0130nsan Haklar\u0131 Evrensel Bildirgesi\u2019ne b\u00fct\u00fcn\u00fcyle yer verece\u011fi gibi; bu konudaki t\u00fcm olas\u0131 geli\u015fmelere uyulaca\u011f\u0131n\u0131n pe\u015finen kabul edildi\u011fi h\u00fckm\u00fcn\u00fc i\u00e7erecektir.<\/p>\n<p>Anayasa\u2019da insan hak ve \u00f6zg\u00fcrl\u00fckleri konusunda T\u00fcrk toplumuna \u00f6zel hi\u00e7bir ek madde bulunmayacakt\u0131r.<\/p>\n<p>5. \u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasa, \u00e7a\u011fda\u015f d\u00fcnyada \u201cd\u00f6rd\u00fcnc\u00fc g\u00fc\u00e7\u201d olarak an\u0131lan kitle ileti\u015fim organlar\u0131n\u0131n \u00e7a\u011fda\u015f demokratik hukuk devletine sayg\u0131l\u0131 i\u015flev vermelerini esasa ba\u011flayan ilkelere muhakkak yer verecektir.<\/p>\n<p>B\u00f6ylelikle, bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc toplumsal mutabakat sonucu (siyasi otorite de\u011fil) tan\u0131mlanacak; ayn\u0131 konuda s\u00fcregelen tart\u0131\u015fmalara son verilebilecektir.<\/p>\n<p>6. \u00d6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz anayasa, anayasan\u0131n onaylanmas\u0131 ve de\u011fi\u015ftirilmesi yetkisinin, Devlet Ba\u015fkan\u0131\u2019n\u0131n \u00f6nerisi ile, toplum iradesine verildi\u011fi h\u00fckm\u00fcne muhakkak yer verecektir.<\/p>\n<p><strong>Anayasalar Toplumsal S\u00f6zle\u015fmelerdir<\/strong><\/p>\n<p>Liberal Demokrat Parti olarak biz, \u00e7ok farkl\u0131 ve acil ko\u015fullar\u0131n \u00fcr\u00fcn\u00fc olan 1924 Anayasas\u0131\u2019n\u0131 hari\u00e7 tutarsak, T\u00fcrkiye Cumhuriyeti\u2019nin hi\u00e7bir anayasas\u0131n\u0131n, milli ya da, toplumsal iradenin \u00fcr\u00fcn\u00fc olmad\u0131\u011f\u0131na inan\u0131yoruz<\/p>\n<p>Oysa, anayasalar bir milleti devlet yapan \u201ctoplumsal s\u00f6zle\u015fmeler\u201d dir ve toplumsal mutabakat \u00fcr\u00fcn\u00fc olmalar\u0131 gerekir.<\/p>\n<p><strong>Ba\u011f\u0131ms\u0131z Yarg\u0131<\/strong><\/p>\n<p>\u00c7er\u00e7eveyi b\u00f6ylece \u00e7izdikten sonra, tekrar konumuza d\u00f6nersek, demek ki, \u00f6ng\u00f6rd\u00fc\u011f\u00fcm\u00fcz sistemde yarg\u0131 ger\u00e7ek anlamda ba\u011f\u0131ms\u0131zd\u0131r. Bu sistem i\u00e7inde h\u00e2kimler ve savc\u0131lar, Devlet Ba\u015fkan\u0131nca atanm\u0131\u015f ve Meclisce onaylanan hakimlerden olu\u015fan bir organa (Y\u00fcksek Mahkeme) ba\u011fl\u0131d\u0131rlar. Bu organ, tayin, maa\u015f, vb konularda \u00f6zerktir.<\/p>\n<p>T\u00fcrkiye\u2019de yeti\u015fmi\u015f, kaliteli bir yarg\u0131 s\u0131n\u0131f\u0131, adalet s\u0131n\u0131f\u0131 mevcuttur. Bu s\u0131n\u0131fa, kendi kendini kontrol edecek, idari tayinler vb konularda kendi \u00f6z mekanizmalar\u0131n\u0131 i\u015fletecek imk\u00e2nlar tan\u0131rsan\u0131z, hakiki ba\u011f\u0131ms\u0131z yarg\u0131y\u0131 ortaya koymu\u015f olursunuz.<\/p>\n<p>Bu i\u015fleyi\u015f i\u00e7in ek kayna\u011fa gerek yoktur. Adli har\u00e7lar art\u0131r\u0131lacakt\u0131r, o kadar. T\u00fcrkiye\u2019de \u00f6zellikle, ticaret mahkemelerinden al\u0131nan har\u00e7lar zaten d\u00fcnya standard\u0131n\u0131n \u00e7ok alt\u0131ndad\u0131r. Kurulan sistemin esas\u0131 budur. Yarg\u0131ya mali ve idari ba\u011f\u0131ms\u0131zl\u0131k verilecektir.<\/p>\n<p>Yukar\u0131da da ifade etti\u011fim \u00fczere, b\u00fct\u00fcn bu yeni bir anayasa ve bir dizi yeni kanun meselesidir. Biz T\u00fcrk toplumunun buna haz\u0131r oldu\u011funa g\u00f6n\u00fclden inan\u0131yoruz.<\/p>\n<p><strong>Anayasa De\u011fi\u015fiklikleri Hep G\u00fcndemdedir<\/strong><\/p>\n<p>Mal\u00fbm, T\u00fcrkiye\u2019de anayasa de\u011fi\u015fikli\u011fi konusu g\u00fcndemden hi\u00e7 \u00e7\u0131kmaz. Bu 60\u2019larda da, 70\u2019lerde de, 80\u2019lerde de b\u00f6yleydi; \u015fimdi de b\u00f6yle. Hem konu g\u00fcndemden hi\u00e7 \u00e7\u0131kmaz, hem de bu konuda yetki sahibi TBMM hi\u00e7 yol almaz \u00e7\u00fcnk\u00fc, bence asl\u0131nda \u201cneden\u201d anayasa de\u011fi\u015ftirilmeli hususunda mutabakat has\u0131l olamaz.<\/p>\n<p>Anayasalar \u201cdar\u201dd\u0131r, \u201cbol \u201cdur; demokratiktir, antidemokratiktir; millidir, de\u011fildir; \u201csivil \u201d dir, askeridir derken, siyas\u00eelerimiz hep belirli maddelere tak\u0131l\u0131r kal\u0131rlar ve de\u011fi\u015fiklik konusu partiler aras\u0131 pazarl\u0131k konusu olmaktan \u00f6teye gitmez.<\/p>\n<p>Biz inan\u0131yoruz ki, T\u00fcrkiye\u2019nin bir \u201cdemokratik hukuk devleti\u201d olmas\u0131 konusunda toplumsal mutabakat \u00e7oktan olu\u015fmu\u015ftur fakat, bu durum TBMM\u2019de, yine yukar\u0131da ifade etti\u011fim nedenlerle, yans\u0131mamaktad\u0131r. Neden?<\/p>\n<p><strong>Meclis Diktalar\u0131<\/strong><\/p>\n<p>Mevcut d\u00fczende bir siyasi parti TBMM aritmetik \u00e7o\u011funlu\u011funu ele ge\u00e7irdi\u011fi an, yasamaya da, y\u00fcr\u00fctmeye de, yarg\u0131ya da egemen olabilmektedir. Kabul ediniz ki, bu inan\u0131lmaz bir g\u00fc\u00e7t\u00fcr hatta, ihtirasl\u0131ysan\u0131z (ki, politikac\u0131 do\u011fas\u0131 gere\u011fi ihtirasl\u0131d\u0131r) vazge\u00e7ilemez bir g\u00fc\u00e7t\u00fcr.<\/p>\n<p>Demokrasi gelene\u011finiz de s\u0131\u011f ise ya da yoksa, bir t\u00fcr \u201cmeclis diktas\u0131\u201d kurmak size son derece cazip gelecektir. Dahas\u0131, bu durumu i\u00e7inize sindirdi\u011finiz oranda, savunabilirsiniz de: TBMM \u00e7o\u011funlu\u011fu bende diye, toplum ad\u0131na en iyisini, en do\u011frusunu yapt\u0131\u011f\u0131n\u0131z\u0131 iddia edebilir ama, asl\u0131nda, toplum ve bireyleri \u00fczerinde muazzam bir tahakk\u00fcm olu\u015fturursunuz.<\/p>\n<p>Mutabakat yani, \u201coy birli\u011fi\u201d ile\u201doy \u00e7oklu\u011fu\u201d ayr\u0131 \u015feylerdir; bunlar\u0131 birbirine katiyen kar\u0131\u015ft\u0131rmamak gerekir hele de \u00e7o\u011fulcu demokrasiden s\u00f6z ediyorsak!<\/p>\n<p>Bug\u00fcnk\u00fc durum, maalesef, budur. Siyasi partilerimizin kendi i\u00e7lerindeki delege sistemi gibi anti-demokratik uygulamalar\u0131n ve tabii, ha bire Se\u00e7im Kanunu de\u011fi\u015fikli\u011fine gitmek istemelerinin temelinde hep TBMM aritmetik \u00e7o\u011funlu\u011funu ele ge\u00e7irme istemi yatmaktad\u0131r.<\/p>\n<p>\u00d6zetle, diyece\u011fim \u015fu ki, anayasa de\u011fi\u015fikli\u011fi konusuna siyasilerimizce mutabakatla g\u00f6sterilen tek \u201cneden \u201c, demokratik hukuk devletinin tesisi olarak ifade bulmad\u0131k\u00e7a, hi\u00e7bir yere gelemeyiz. Mevcut anayasan\u0131n \u015fu ya da bu maddesini de\u011fi\u015ftirerek \u00f6zledi\u011fimiz hukuk devletine kavu\u015fmam\u0131z m\u00fcmk\u00fcn de\u011fildir; \u00f6zledi\u011fimiz demokratik hukuk devleti yani, yarg\u0131 ve hukuk devleti yani, \u00e7a\u011fda\u015f, uygar devlet!<\/p>\n<p>\u00d6zendi\u011fimiz, hedef koydu\u011fumuz \u201cbat\u0131 uygarl\u0131\u011f\u0131\u201d liberal-demokratik bir uygarl\u0131kt\u0131r ve son 200 y\u0131ll\u0131k d\u00fcnya tecr\u00fcbesi \u015funu ortaya koymaktad\u0131r ki, liberal demokrasi yarg\u0131n\u0131n g\u00fcc\u00fc oran\u0131nda ger\u00e7ekle\u015febilir. \u00d6rne\u011fin, ABD ta 1800\u2019lerin ba\u015f\u0131ndan itibaren devletin t\u00fcm tasarruflar\u0131n\u0131n yarg\u0131 denetimi alt\u0131na al\u0131nmas\u0131n\u0131n \u00f6nc\u00fcl\u00fc\u011f\u00fcn\u00fc yapm\u0131\u015ft\u0131r.<\/p>\n<p>ABD\u2019de t\u00fcm kamu hizmetlerinin etkin bi\u00e7imde yerine getirilmesinin ard\u0131nda, bireyi devlete kar\u015f\u0131 e\u015fitlik\u00e7i anlay\u0131\u015fla kollayan ve gere\u011finde kamuyu en a\u011f\u0131r bi\u00e7imde cezaland\u0131rabilen g\u00fc\u00e7l\u00fc yarg\u0131 yatmaktad\u0131r.<\/p>\n<p><strong>Ekonomik Geli\u015fmi\u015flik ve Yarg\u0131<\/strong><\/p>\n<p>Bir \u00fclkenin ekonomik ve teknolojik geli\u015fmi\u015fli\u011fi de yarg\u0131ya endekslidir.
